Terms Of Service

01 General Terms

  • Prices are subject to change based on demand.

  • I have the right to reject any order for any reason.

  • Please tell me if you don't agree with me sharing WIPs online.

  • Inform me if the order is a gift that should not be published before day X.

  • You are paying for digital content and private use only (if not otherwise stated).

  • If there was a waiting list, I may finish commissions in chronological order. It´s first payed, not most payed.

  • In exceptional cases it can take up to 3-5 days until I can reply to e-mails. Please note that I only do art commissions on a part-time basis and I may need some time to estimate the scope for increased or complex requests.

  • Do not ever ask me about NFT or A.I.!

02 Payment / Refunds

  • Currency accepted is either USD or EUR and can be paid through PayPal, Stripe or bank transfer.

  • Commissions must be paid 100% in advance.

  • Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.

  • Once you placed your order and paid the full amount, the order can´t be withdrawn anymore.

03 Process & Delivery

  • The time it takes to finish your commission varies 1 week - 3 months depending on factors such as health, the complexity of the commissioned piece, other work, etc.

  • Please note that short deadlines are not possible. If there is a special date such as an anniversary, birthday, holiday or something similar, please let me know right at the beginning. This way I can tell you if the date would be feasible for me or not.

  • Once the piece is finished you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product.

How does the process work?

  1. Provide a full description and references of your request / project.

  2. Contact me via e-mail (preferred), social media or commission websites for discussion.

  3. I will accept or disline your request.

  4. You pay me the full amount upfront.

  5. I may send you reference images of poses or start sketching right away.

  6. You confirm the sketch or ask for adjustments.

  7. For colored work: Depending on whether I start in grayscale first, you may need to review and request small changes at this stage before you receive the colored version. (small adjustmens possible).

  8. You confirm the final version and receive the full-resoluted artwork + watermarked version for online sharing.

What informations do I need from you?

  • A visual reference of the character. That can be a character sheet or existing artworks.

  • A description, rough sketch or photo references for the pose and expression.

  • I´d love to know about the characters name, age and personality or favourite colors to consider in the overall look.

  • [Optional] If you choose a detailed background, I will need informations about that, too.

  • [Optional] If you don't agree with me posting WIPs online or your order is a gift that shouldn't be posted until day X, you need to let me know.

04 Revisions

  • You get 3 rounds of changes on the commissioned piece included in the price.

  • A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.

  • If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.

  • If your reference is unclear to start with, changes will come at an extra charge.

05 Copyright & Usage

I, Lacrimaart (the artist):

  • I reserve the right to cancel and refund the order at any time for any reason.

  • I retain all copyrights over the commissioned artwork.

  • I will NOT claim the intellectual property (IP) of the commissioned artwork unless you (the customer) break any of the terms (e.g. reselling, pretend to be the artist, erase watermarks, ...).

  • I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms (exception: usage for exclusive content on platforms like Patreon / Kofi and paid wallpapers).

  • I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books. This also includes WIPS and the usage in (speedpaint / art) videos.

You (the customer/commissioner):

  • You may upload the commissioned artwork on any website and social channels, as long as you credit* me for my work. Only use the given watermarked / smaller version of it to prevent it from art theft.

  • You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, mint NFT´s, use it for A.I., etc.)

  • You may NOT alter the commissioned artwork without my (the artist's) consent.

  • You MAY be allowed to sell the artwork if it is a part of an Adoptable. Please discuss this with me prior to paying for the artwork.

  • You retain the rights to the intellectual property (IP).

  • You may NOT use the commissioned artwork for commercial purposes.

The following is considered copyright infringement:

  • Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms (examples: Selling digital goods or prints, mint NFT´s or use it for A.I.).

  • Claiming the artwork as your own.

  • Altering the artwork without my consent.

  • Cutting out watermarks or signature.

In some cases, commercial rights to the image may be purchased. Please contact me in advance so we can talk about the additional fees before payment.

06 Cancellation & Refund Policy

  • The buyer is not allowed a refund once I started working on the commission.

  • If for any reason I am unable to start your commission you will receive a full refund.

  • If you cancel your order before I started it, you can get a full refund. If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.

  • If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

What do you get?

  • Sketch and / or final sketches that you must accept before I continue the work (depending on the complexity of the commission there might be fewer or more drafts).

  • Insight and involvement in color plan (depending on the complexity of the commissioned piece).

  • Full-resolution file (approx. 210 x 297 mm at 300 DPI) of final drawing and a smaller version for internet upload. Final file formats are usually PNG. An exception is custom icons, which are delivered in the individual resolution.

  • We can also discuss on print optimized files (for example custom magic card or poster for private usage such as wall decor). Ask me about it in advance.


(Non-)AcceptableTopics

Do´s & Don´ts

I will draw:

  • All kind of genders and identities

  • All types of skin tones (no extra fees for corrections)

  • Humans, humanoid, anthro

  • Animals and animal characters

  • Closed/open species (only with permission of the species owner)

  • Mild gore / horror (no extrem)

  • Fanart (not every, please ask me)

  • Pinup, artistical nudity (hidden body parts)

I will NOT draw:

  • Porn, explicit NSFW, genitals, fetish, BDSM

  • Underaged nudity/saucy

  • Extrem muscles

  • Body inflation

  • Pregnants, babies, very old people

  • Pony, Sonic

  • Racism, sexism, homophobia or other hatred

  • A copy of someone else style or art


By commissioning me, you have read and agreed to my Terms Of Service. You are of legal age or you have received permission from a parent or guardian.
